General Litigation / Insurance Claims

General Litigation
Joe Moiloa, Daan Roberts, Denis Molyneaux, Lebohang Molete, Eugéne Holtzhausen, Motlatsi Mpobole and Retief Koekemoer and Francois Retief run this department. It comprises acting on behalf of clients and correspondents in legal proceedings in the lower and higher courts of South Africa and Lesotho. Instructions are received from clients and correspondents in both the Free State and outside its borders, as well as local individuals and companies. Some matters that the firms handle in large quantities are dealt with by the abovementioned partners and assistants in smaller departments, as set out elsewhere. Consequently, the firms have extensive experience of all different types of litigation including commercial, insurance, general disputes, labour and administrative law issues and major matters involving financial institutions and banks.

Insurance Claims
The firms specialise, inter alia, in claims arising from insurance, firstly motor vehicle accident claims in terms of the South African Road Accident Fund Act and the Lesotho MVA Act and secondly claims based on short term insurance policies. Denis Molyneaux, James Grundlingh, Craig Grant and Alfred Schmidt handle these. In addition the firms have the services of Jim Newdigate, a former senior partner with more than 40 years experience who is widely known for his knowledge of the insurance laws in general and third party claims in particular. The firms are regularly involved with claims for material damage resulting from inter alia fires, public liability and personal injuries.
