Labour Disputes / Appeals to the Appellate Division / Arbitrations

Labour Disputes
Joe Moiloa, Eugéne Holtzhausen and Alfred Schmidt deal with labour disputes between employers and employees, some of which lead to trials in the relevant courts in Lesotho and South Africa. They frequently act for employees in internal disciplinary trials and enquiries. It is anticipated that this department will in future also be responsible for handling human rights issues.

Appeals to the Appellate Division
Bloemfontein is the seat of the Appellate Division of the High Court of South Africa, while Maseru is the seat of the Court of Appeal of Lesotho. The firms have a substantial department for the handling of appeals to the Appellate Division and the Court of Appeal from the lower courts all over both countries on instructions from both clients and correspondents. Eugéne Holtzhausen is in charge of the Bloemfontein section of this department while Maseru appeals are handled by Joe Moiloa, Daan Roberts and Denis Molyneaux. In addition, the firms also offer expertise with regard to the preparation of appeal records.

Arbitrations
Both the Bloemfontein and the Maseru firms have extensive experience of the conduct of major arbitrations and Denis Molyneaux was recently involved in a large arbitration involving the Lesotho Highlands Water Project. Joe Moiloa also does this type of work in Maseru.
